CHILD CUSTODY AND SUPPORT
The law and the court will
only consider what is in the best interests of the child(ren). Our

not consider the best interests of the children.
The Texas child support
guidelines are very rigid and there is little an attorney can do
about it. Health insurance is also a part of child support.
Regarding child custody and access to the children, there are several
options:
. standard possession (typically
every Thursday from 6 p.m. to 8 p.m. and every first, third and
fifth Friday from 6 p.m. to the following Sunday at 6 p.m.; summer
vacation is 30 days)
.extended standard possession
(every Thursday from the time school recesses until the time school
resumes the following day and every first, third, and fifth Friday
from the time school recesses until the time school resumes on Monday
or if it's on school holiday, then the following Tuesday; summer
vacation is normally 42 days)
.agreed co-parenting plan
or shared parenting plan
It may be very important
for you to have sole custody of the children after the divorce.
But keep in mind that courts are very concerned that the children
have healthy relationships with each parent.
Studies have shown that
children benefit from a stable parenting plan, little or no conflict
between the parents and a civilized relationship with your ex-spouse.
What happens if the
parties can't come to an agreed parenting plan?
Answer: (assuming that the child is old enough and there are no
problems with the non-custodial parent such as violence) The non-custodial
parent may opt for either standard or extended standard possession.
The extended standard possession schedule typically gives the non-custodial
parent 14 days per month with the children.
