Qualified Domestic Relations
Orders (QDROs)
The court may divide retirement
benefits through a Qualified Domestic Relations Order (QDRO). The
QDRO divides the employee benefits earned by an employee or participant
and gives what percentage or amount is to awarded to the non-employee
or non-participating spouse.

drafting QDROs. There are various requirements to qualify domestic
relations orders under various corporate, teacher retirement, local,
state, and federal government plans and military plans. Defined
contribution plans such as 401(k) plans and pensions plans have

Examples of dividing
benefits
Mr. Hughes represented
the non-employee spouse whereby the court has awarded his client
a percentage of the retirement benefits and the stock options. Ultimately,
his client received sufficient monies to start over and purchase
a home. Mr. Hughes drafted the QDROs.
Mr. Hughes recently represented
the non-military spouse to obtain half of the military spouses
retirement and again Mr. Hughes drafted the QDRO. His client is
now receiving half of the military retirement benefits.
