PREMARITAL AGREEMENTS
Premarital agreements allow
a person to marry and to preserve their separate property. For example,
under Texas law, the income from separate property is community
property. A prenuptial agreement can state that income from separate
property during the course of a marriage is separate property. The
result is that the court can not touch separate property.
When a persons separate
property is commingled with community property, the separate property
can become community property. Prenuptial agreements preserve a
persons separate property and help to keep it separate.
Prenuptial agreements may
involve:
Wills and trusts
Rights to control property
during the marriage
Dividing retirement and
employee benefits
Homestead rights
We have been writing prenuptial
agreements to protect separate property for a long time.
We can write a prenuptial
agreement between you and your loved one prior to marriage to protect
your separate property and your loved ones separate property.
