PREMARITAL AGREEMENTS

Premarital agreements allow a person to marry and to preserve their separate property. For example, under Texas law, the income from separate property is community property. A prenuptial agreement can state that income from separate property during the course of a marriage is separate property. The result is that the court can not touch separate property.

When a person’s separate property is commingled with community property, the separate property can become community property. Prenuptial agreements preserve a person’s separate property and help to keep it separate.
